4. INSURANCE AND INSURANCE CLAIMS

MNHW does not accept assignment. MNHW is not a provider for any insurance company or health care organization. MNHW does not file any insurance claims or bill any insurance companies for any reason. All purchases made on madenewhealthandwellness.com are cash purchases. MNHW does not work with private or government based insurers or social benefit programs. MNHW is not a Medicare provider nor does it have a Medicare number. Medicare will not reimburse you for purchases you make on madenewhealthandwellness.com.

5. ACCOUNT INFORMATION

Should MNHW at any point in time decide to allow users to create personal accounts on the Websites, you agree to provide true, accurate, current, and complete information about yourself. It will be your responsibility to maintain and promptly update this account information to keep it true, accurate, current, and complete. If you provide any information that is fraudulent, untrue, inaccurate, incomplete, or not current, or MNHW has reasonable grounds to suspect that such information is fraudulent, untrue, inaccurate, incomplete, or not current, MNHW reserves the right to suspend or terminate your account without notice and refuse any and all current and future use of the Websites. MNHW reserves the right, in its sole discretion, to terminate your access to any or all of MNHW’s Websites and the related services or any portion thereof at any time, without notice. MNHW may also terminate your account for inactivity or any other reason at MNHW’s sole discretion. 17. SECURITY

The use or distribution of tools designed for compromising security (e.g., password guessing programs, cracking tools, or network probing tools) is strictly prohibited. 18. MISCELLANEOUS

These Terms of Use will be governed and interpreted pursuant to the laws of the State of Indiana, United States of America, notwithstanding any principles of conflicts of law. You specifically consent to personal jurisdiction in the State of Indiana in connection with any dispute between you and MNHW arising out of these Terms of Use or pertaining to the subject matter hereof. The parties to these Terms of Use each agree that the exclusive venue for any dispute between the parties arising out of these Terms of Use will be in the state courts in St. Joseph County, Indiana or the federal courts in the Northern District of Indiana.

If any part of these Terms of Use is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and MNHW as a result of these Terms of Use or your use of MNHW’s Websites.

Resale of products, services, or information purchased or obtained in connection with the Websites is specifically prohibited.

These Terms of Use constitute the entire agreement among the parties relating to this subject matter and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written between the user and MNHW with respect to MNHW’s Websites.

Failure by MNHW to take action for a violation of these Terms of Use in no way waives MNHW’s rights to take action with respect to subsequent or similar violations.
